Dear Bill,
 
Board of Supervisors resolution 2005-105 Condition of Approval # 49 requires that "All handicap parking and loading areas shall meet State of California and federal accessibility standards.
 
The slope of Marin Horizon School's non-conforming passenger loading  zone's vehicle pull up space and adjacent access aisle  (see 24.04.340 (p) ) on Melrose Ave. does not conform to Uniform Federal Accessibility Standard section 4.6.5 PASSENGER LOADING ZONES.
 
4.6.5 PASSENGER LOADING ZONES. Passenger loading zones shall provide an access aisle at least 60 in (1525 mm) wide and 20 ft (6 m) long adjacent and parallel to the vehicle pull-up space (see Fig. 10). If there are curbs between the access aisle and the vehicle pull-up space, then a curb ramp complying with 4.7 shall be provided. Vehicle standing spaces and access aisles shall be level with surface slopes not exceeding 1:50 in all directions.
 
I believe you will concur that the above Federal Accessibility Standard 4.6.5 PASSENGER LOADING ZONES has precedence over all California accessibility standards including but not limited to California Building Code and or California Health and Safety accessibility standards and that the County has no authority to grant exceptions to federal accessibility standards.
 
You  are respectfully requested to require Marin Horizon School to comply with resolution 2005-105 and Uniform Federal Accessibility Standard section 4.6.5 PASSENGER LOADING ZONES.
 
By this email DPW is informed that the SR2S sidewalk and passenger loading area shall be designed to meet Uniform Federal Accessibility Standard section 4.6.5 PASSENGER LOADING ZONES.
