Unlike other sections of CBC Chapter. 11, CBC 1131B includes no exemptions from CBC 1131B requiremebts for any reason.
Separate but equal facilities is discrimination.
The County has no legal right to grant any exemptions except as expressly stated in a specfic CBC section.
And none are provided for in CBC 104.2.7 or 1131B Marin Horizon School can comply with CBC 1131B and Title 24.04. 330, 335 a) and 340 P) simply by relocating its Melrose Ave, passenger loading area to an on-site location.
In their 2003 Marin Horizon School design review merit review comments , DPW's Mr. Nutt and Ms. Mitra Moheb failed to require Marin Horizon School to conform to these Title 24 ordinances which resulted in a granting of special privilege and Marin Horizon School using Melrose Ave.'s rightof-way for it's non-conmforming ADA passenger loading area.
