Subject: Complaint: Marin Horizon School is in flagrant non compliance with resolution 2005-105 Condition of Approval # 18

Complaint: Marin Horizon Inc.is in flagrant non compliance with resolution 2005-105 Condition of Approval # 18 to implement Marin Horizon Schools (MHS) Traffic Management Plan (TMP) Strategy I-B-1 and Strategy I-B-2.
1. During a 7 day morning monitoring observation of Marin Horizon Inc (MHI) compliance with MHS' Traffic Management Plan (TMP) Strategy I-B-1 Staff assistance at drop-off and pick-up showed MHI failed to comply with MHI.'s requirement to have 3 monitors present during drop-offs and pick-ups. During the monitoring period 07:30 -08:30 AM (28/9 - 07/10) only 2 monitors were present not 3 as required.
2. During a 7 day afternoon monitoring of Marin Horizon Inc (MHI) compliance with MHS' Traffic Management Plan (TMP) Strategy I-B-1 Staff assistance at drop-off and pick-up showed MHS failed to comply with Strategy I-B-1 requirement to have 3 monitors present during drop-offs and pick-ups. During the afternoon monitoring period 03:00 - 4:00 PM (28/9 - 07/10) NO MONITORS were present not 3 as required.
3. During a 7 day I-B-2 afternoon monitoring of Marin Horizon Inc (MHI) compliance with MHS' Traffic Management Plan (TMP) Strategy I-B-2 Crossing Guard. MHS failed to comply with Strategy I-B-2 requirement to have 1 crossing guard present during drop-off and pick-up at Melrose and Evergreen During the afternoon monitoring period 03:00-04:00 PM (28/9 - 07/10) NO CROSSING GUARD was present not 1 as required.
You are respectfully requested to enforce Marin Horizon Inc's compliance with resolution 2005-105 Condition of Approval # 18.
And to issue a formal notice of non-compliance to Marin Horizon Inc. noticing Marin Horizon Inc that its daily failure to comply with resolution 2005-105 Condition of Approval # 18 MHS' Traffic Management Plan my result in the revocation of its USE PERMIT pursuant to resolution 2005-105 Condition of Approval # 18 D and Marin County Code Section 22.120.030.
And pursuant to the California Public Records Act to copy me with a copy of the formal notice to Marin Horizon Inc of its daily failure to comply with resolution 2005-105 Condition of Approval # 18 MHS' Traffic Management Plan.
