The below email confirms that Marin Horizon School is indeed in violation of BOS resolution 2005-105 MHS Use Permit Condition of Approval # 49 and CBC 1131.B.2.
We will believe the County intends enforce BOS resolution 2005-105 MHS Use Permit Condition of Approval # 49 and CBC 1131.B.2. when we see a "red tag" publicly displayed on the Melrose Ave. entrance to MHS.
The County publicly post a "Red Tag" violation notice for all too see as Marin Horizon School has no right not to be treated the same as all other Marinites that are in violation of County requirements.
The County is respectfully requested to equally treat MHS the same as all other violators.

I apologize for how long it has taken for my office to provide further feedback
on the status of actions taken in response to your complaint regarding the
passenger loading zone at the Marin Horizon School. The discrimination complaint
investigation required a comprehensive site survey and coordination with several
County Departments. The County is now working with school officials to resolve
this issue. I will monitor progress and keep you apprised of further
developments until this issue is fully resolved.

This email confirms that with the exception of District Attorney
Berbrian, as of today 16 February 2009 the following individuals S.
Kinsey, B. Crawford, W Campagna, B. Kelly, and F.Mansourian have not
provided a response to the below email request.
On site observation confirms that Marin Horizon School is now and has
been since 1991 in flagrant violation of State and Federal accessibilty
requirements.
The below request was made in acordance the State of California's
Attorney General's procedures.
Its a sad day in Marin County when a private citizen must require
elected official and county employees to enforce county, state and
federal ordinances and acts.

As of today's date February 7, 2009, I am unaware of any Marin County,
California's enforcement action taken re: Subject.
Regretfully, I must respectfully request each and every recipient of
this email to explain by email, by close of business February 12,
2009, what action you have taken, since on or about May 27, 2009, to
require Marin Horizon School (MHS), 305 Montford Avenue, Mill Valley,
Marin County, California to:
1) Comply with Board of Supervisors' Resolution 2005-105
Condition of Approval # 49 dated 30 August 2005.;
2) Modify MHS' non-conforming non-accessible student passenger
drop-off loading zone within the right-of-way of Melrose Avenue to
conform completely and fully to California Building Code (CBC) 1131.B.2
and federal accessibility requirements.
If each and every recipient of this email has taken no action to
enforce MHS compliance to 1) and 2) above since on or about May 27 2009
then each and every recipient of this email is respectfully requested
to justify why you have taken no action since May 27 2009 to enforce
Marin Horizon School's compliance with Resolution 2005-105 Condition of
Approval # 49 and enforce MHS' complete and full conformance to
CBC1131.B.2. and federal accessibility requirements
