Subject: Evergreen Avenue Proposed Sidewalk

Dear Mr. Mansourian:

We would appreciate a clarification of something you said at the recent meeting regarding the proposed sidewalk on our street. You said that State law requires that the residents are responsible for the sidewalk's maintenance. We would like to know what form this responsibility takes:

1) does each individual property owner personally clean and maintain the piece of sidewalk in front of his property? And when it gets undermined or uneven due to drainage issues, does that individual have to call on a private contractor to repair it?
2) or does the County create an assessment on each of these properties, and the County then fixes the sidewalk when it gets undermined or uneven? If so, even though you stated that our taxes won't go up because this is a "Safe Routes To School" grant, our tax bill WILL, in fact, increase.
3) what about the properties on the north side of the street, who presumably also benefit from having a sidewalk on the street? Do they have any financial responsibility, or does it fall solely on those on the south side?
4) or is there some other financial method for handling the issues that will arise? You stated that the sidewalk will "probably be good for ten years;" that is not a very long time before we will be looking at repairs--and even less if the drainage issues aren't solved.

We look forward to a letter from you so that we will be clearer on this issue. Thank you.

Respectfully,

Paul & Nancy Reck
