Oh ???????????  Yet you don't explain why you accused me of wanting to take legal action in correctly and why you suppressed ersedes last MHS damaging paragraph. Your explanation is pathetic as you know full well no one in Homestead Valley reading an email  would go to another site unless specifically instructed to go there by "see www.web site" for continuation."

However, I usually tend to truncate excessively long emails, and reference them with a link.

Sufficiently documented facts, consultant reports  and correspondence exist to support the above allegations.
A. The following recent "Facts" below illustrate the fact that the County will permit MHS to do anything it wants and why it is futile to talk the County into also protecting Homestead Valley and Evergreen Ave. neighborhood interests.
Fact 1: 59 % of the weekly average of all east/west bound vehicles on Evergreen Ave. in the morning when MHS students are walking to school are MHS vehicles. A significant negative traffic  impact not included in MHS' Environmental Initial Study (EIS) used to gain Board of Supervisors approval. See Fig. 1 and 3.
Fact 2: It is very probable that the blue Prius that Hanne Barnes described in her below email was in fact a Marin Horizon School parent's vehicle that had just dropped a K-8 student off at school. 
Fact 3.  Marin Horizon Vehicles are required to have an identifying "cling sticker" on its windshield. Ref. 2005-104 and 2005-105 is not enforced by the County.
Fact 4. 58 % of the weekly average of all east/west bound vehicles on Evergreen Ave. in the afternoon when MHS students are walking from school are MHS vehicles . Your above selective, biased, editing of my my "Bickering and Resistance is futile" email is a precise exasmple of  why I have no interest in either of your "communication" ventures "Hearus" and "HV Beat".
Inmy view your ventures "monitor" and manipulate reality in order to steer any discussion or comment away from the sole cause of  the neighborhood "uproar" which everyone knows is Marin Horizon School.

I hope you had a Merry Christmas. This is a somewhat delayed response to your recent email, subject line "Bickering and Resistance Alone are Futile," which partially follows below. 
As you may know, since August, many of our neighbors have expressed their greatest disappointment with the "process" and lack of communication surrounding the sidewalk project http://www.hv94941.com/2010/08/homestead-residents-meeting-8172010.html

Please allow me to remind you that the "hear us" group and  (the blogs )were founded from a dissatisfaction with the above referenced lack of communication. These are growing community efforts to give our neighbors more complete information and alternate perspectives than those shared through the Headlines, and any other individual email list. The HEAR US group is an opportunity to engage in discussion. I'm sorry that you chose to leave the group rather than adhere to our moderation guidelines, but I respect your decision to do so. 

I have done my best to explain to you that I welcome your input and respect your work, which is why the "Sands Box" exists as satellite blog on the "BEAT." It was never my intention to "exploit" anyone and I find it insulting that you or anyone else would consider it as such. May I respectfully suggest that you look up the word "exploit" in the dictionary? I have certainly witnessed you "exploiting" the information shared in the HEAR US group to attack our neighbors. (Please refer to 8/21/10 on the sidewalk timeline for at least one reference : )

Since you brought it up, did you ever stop to consider that you are "exploiting" how strongly some of us feel about this sidewalk issue to stoke the embers of your personal feelings of resentment for the MHS expansion? That said, please understand that I am not disputing your or anyone else's claims that MHS is not adequately following the requirements of their Use Permit - and/or claims that the County could and should do a better job of enforcing same (especially before forcing 10,000 plus feet of unwanted concrete on a semi rural street with a perfect safety record.) But as you have noted yourself, the expansion has happened, the school has a long lease. Don't you think we would all be better served to make lemonade out of lemons instead of constantly griping about it - about something that has already happened?

Are you afraid of losing your self appointed position as the "voice" of Homestead? Because that is the only explanation that I can find to explain why you choose to repeatedly attempt to undermine these community efforts to improve communication. Several of us are working together to create a central place to archive helpful information and share what is going on in our community. It is a work in progress and further input and suggestions are welcome to improve these tools. If you feel exploited, please let me know and I will remove the "Sands Box" from our satellite blog list. 

I have to be honest with you, Mr. Sands, if anything is "tiresome" around here, it is your knee jerk "no" to everything and anything that has any remote connection to MHS and your unending stream of emails insisting that we file a lawsuit against the County at this time. It makes no sense to file a lawsuit before giving the County time to digest the overwhelming amount of resident feedback with regards to this sidewalk project. 

Also, may I please remind you that the "uproar" about this sidewalk project (and the expansion, for that matter ) happened due to lack of proper and complete communication to residents from MHS and the HVCA. So let's work together with MHS and the HVCA  - from this point forward - to provide more complete information to our neighbors and our elected government representatives. 

Perhaps in addition to asking "How did we get here?" We should be also be asking : "Where do we go from here?"

Bickering is futile and leads no where except to ensure 5'-0" wide sidewalks and narrowing of  our streets. It does not aid in developing a unified 2/3 majority pro/con Homestead Valley community position to put before Supervisor Kinsey.
Rather than "pushing" a proposed plan for Evergreen Ave. or exploiting some Homestead Valley property owners and Marin Horizon School parents pro/con opinions to establish a Hearus group or HV Beat website it would be more helpful if these two antagonists could come together to actively achieve a unified community consensus concerning the future of Evergreen Ave.
It is true that I have not forwarded all emails sent to me. I do not forward emails that solely advertise a web site or group such as HV Beat or Hearus not their email addresses.
I do forward unedited/uncensored all emails received regardless of their tone.
It' fairly tiresome to read a "moderator's  personal attacks on me or others that the "moderator" does not agree with and the "moderator's refusal to not make public the opinions of others because the "moderator" finds the "tone" or "content that opinion to objectionable. 
I'm relieved that Orwell's 1984' thought control has not yet been accepted in Homestead Valley
This tactic is most frequently used by individuals supporting and defending politically correct, progressive positions, actions,  and polices that depends on the philosophy that the "end justifies the means. And without exception these same individuals will claim that this is untrue.
That being said Homestead Valley has much bigger "fish to fry".
RESISTANCE ALONE IS FUTILE.
The Community Development Agency's past Director and his staff, supported by Supervisor Kinsey used any and all devious and deceitful means conceivable to ensure that the Board of Supervisors approved the imposition of Marin Horizon School's proposed expansion plan on Homestead Valley. See recent "unethical conduct" email.
I am confident that Supervisor Kinsey and DPW Director Mansourian will politely listen to all who care to voice their concepts and concerns. And then promptly proceed to implement and build the 5'-0" width sidewalks on Evergreen Ave. and reduce Evergreen and Melrose Ave.'s widths exactly as Marin Horizon School wants.
For nearly 6 months I've heard and read many pros and cons concerning DPW's proposed sidewalk for Evergreen Ave. and Melrose Ave. and narrowing of Evergreen Ave. and Melrose Ave.
However, nearly no-one asks the questions "How did we get here?" "Were did all this traffic come from? Nor address the root cause of the reason necessitating sidewalks and the narrowing of Evergreen and Melrose Ave.
A few "politically correct" Homestead Valley neighbors prefer not to recognize or talk about the fact that a 1,00 lb gorilla, Marin Horizon  School, has been wrongly imposed on Homestead Valley and to acknowledge that the traffic and parking it generates is destroying the semi-rural character and quality of  Evergreen and Melrose Ave.
It is painfully obvious that the County is solidly in the pocket of Marin Horizon School. And that all the emails sent to DPW and concerns expressed at the past two meetings are politely received, ignored and not answered. 
The County is proceeding in 2010 exactly as it did in 2003 -2005. It politely and deceptively appeared to be interested in Homestead Valley's concern then proceeded to do exactly what was solely in the best interest of Marin Horizon School despite Marin orizon
Horizon School's massive negative traffic and parking impacts on its surrounding Evergreen   Ave  neighborhood, its quality of life and, semi-rural character.
Some property owners on Evergreen Ave. have already publicly stated that the only evident way to  cage, control and stop this 1,000 lb. gorilla may be to bring a legal action for relief.
Legal action for relief should be brought against Supervisor Kinsey, the Community Development Agency past and present directors and staff responsible for wrongly, deceitfully and deviously  imposing Marin Horizon School on Homestead Valley alleging: Malfeasance in office for not equally enforcing county ordinances and; The
unethical professional practice of revising and manipulating county ordinances through deliberate errors and omissions to benefit solely Marin Horizon School and resulting in Homestead Valley property owners being deprived of their civil rights to equal protection of the County ordinances County Wide Plan, Tamalpais Area Wide Plan, Title 19 Buildings, Title 22 Development Code, Title 24 Development and the California Environmental Quality Act (CEQA).

Well, Mr. Sands - I agree with you. After almost two years of trying to work with the County, it seems all they respond to is a lawsuit. I wonder how much money Marin County has spent on lawsuits in the past 15 years.
What a waste of time and resources.
